Montana Supreme Court voids voter-approved 'Marsy's Law'

As South Dakota earth haters ponder a beach towel primary ballot just for the attorney general nominee the extremist House speaker, Mark Mickelson is trying to get a repeal for another voter-approved law.

But, in Montana the state's highest court has already overturned a similar statute.
The court issued the order Monday, saying the law was unconstitutional because it violated the separate-vote requirement of the Montana Constitution. The separate-vote requirement says that if more than one change is made to the constitution, it can't be done through a single measure. Last year, voters passed Constitutional Initiative 116 with 66 percent of the vote. It almost immediately was challenged on several fronts, first on the effective date and then on the constitutionality of the initiative.
