In Montana the state Division of Livestock governs bison management but says bison aren't livestock. Judge rules American Prairie can keep buffalo on BLM ground for now: source.
Montana officials like Governor Greg Gianforte argue that if a group is raising bison for conservation or "rewilding" rather than traditional meat/commercial production, those animals shouldn't count as standard production livestock. The BLM declared that conservation-oriented bison are not domestic livestock under the Taylor Grazing Act because they are not "production-oriented" operations.
